Problem: Zoom buttons get sticky if there is not enough data

I'm having a small problem with the zoom buttons. If there is not that much data for the graph, e.g. for example only for the past 3 days, clicking on 1Y or 1M makes the buttons remain pushed and highstock behaves strangely.
So my question is: is this some sort of bug? If not, is there a way I can disable those buttons depending on how much data I get from the ajax source? I know the buttons can be defined in the settings, but couldn't find out how to change the button set once the chart is loaded and it gets the data...
